Enough is Enough."},"content":{"rendered":"<p>I recently finished Kate Harding\u2019s book, <em>Asking for It: The Alarming Rise of Rape Culture-and What We Can Do About It<\/em> (2015). In our current moment, when courageous survivors are coming forward every day to share their experiences of rape, sexual assault and sexual harassment, it continues to be a timely read. It is both accessibly written and rigorously researched.<\/p>\n<p>In the book, Harding takes on misunderstandings about what consent means, and spends significant time correcting the myths and misperceptions about false reporting, noting that \u201cbased on the best available data, we can assume that somewhere between 92 and 98 percent of the time, a person reporting a rape is telling the truth\u201d (61). She goes on to provide examples of what happens when people, particularly law enforcement and the criminal justice system, act as if most reports are false.<\/p>\n<p>Harding discusses the ways in which rape myths affect survivors and their willingness to go forward with their cases or not &#8212; and the mostly negative results when they do. She notes the impact of rape culture and gives multiple examples of it, including in <a href=\"https:\/\/www.huffingtonpost.com\/2012\/03\/25\/belvedere-vodka-rape-ad_n_1377975.html\">advertising<\/a>, in music (see <a href=\"https:\/\/www.theguardian.com\/music\/2013\/nov\/13\/blurred-lines-most-controversial-song-decade\">here<\/a> and <a href=\"https:\/\/www.vox.com\/identities\/2016\/12\/19\/13885552\/baby-its-cold-outside-feminist-date-rape-romantic\">here<\/a>) and in <a href=\"https:\/\/www.thedailybeast.com\/why-daniel-toshs-rape-joke-at-the-laugh-factory-wasnt-funny\">comedy routines<\/a>. Rape culture is what has produced a \u201cculture in which most victims of sexual assault and rape never report it because they fear they won\u2019t be believed \u2013 and know that even if they are believed, they\u2019re likely to be mortified and harassed, blamed and shamed, throughout a legal process that ultimately leads nowhere\u201d (1).<\/p>\n<p>Harding pointedly rebuts the incorporation of the term \u201cgray rape\u201d into any discussion of rape. This term was popularized in <em>Cosmopolitan<\/em> several years ago and works to incorrectly and dangerously blur the lines between sex and rape. Harding writes: \u201cThe \u2018gray\u2019 in \u2018gray rape\u2019 is an imaginary fog of questions about what consent means and whether you really need it <em>every<\/em> time\u201d (148, emphasis in original). Normalizing a term like \u2018gray rape\u2019 leads to victim-blaming and misplaced concern about false accusations of rape. There are really no questions about \u201cwhat consent means and whether you really need it every time.\u201d Consent is not ambiguous, as institutions and states are beginning to recognize with affirmative consent policies, and yes, you really need it every time.<\/p>\n<p>Harding also highlights connections between reproductive justice and rape, arguing that \u201cboth rape and severe abortion restrictions spring from the same fear of women\u2019s sexual autonomy\u201d (126). She describes multiple examples of politicians making claims about rape and pregnancy that range from incorrect to wildly outrageous. Remember Todd Aiken\u2019s bizarre comment about \u201c<a href=\"http:\/\/www.nytimes.com\/2012\/08\/21\/us\/politics\/rep-todd-akin-legitimate-rape-statement-and-reaction.html\">legitimate rape<\/a>,\u201d or Linda McMahon talking about \u201c<a href=\"https:\/\/jezebel.com\/5952223\/introducing-emergency-rape-this-seasons-hottest-rape-trend\">emergency rape<\/a>\u201d? Harding does.<\/p>\n<p>Despite the pervasiveness of sexual violence and society\u2019s completely inadequate response to it, Harding finds \u201cseveral causes for genuine hope\u201d (211):<\/p>\n<ul>\n<li>The <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/letters\/colleague-201104.html\">2011 Dear Colleague Letter<\/a> (DCL) from the Department of Education\u2019s Office for Civil Rights (OCR), which made clear that sexual harassment and sexual violence are covered under Title IX. <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/tix_dis.html\">Title IX <\/a>states: \u201cNo person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.\u201d\n<ul>\n<li>Unfortunately, this DCL was <a href=\"https:\/\/www.ed.gov\/news\/press-releases\/department-education-issues-new-interim-guidance-campus-sexual-misconduct\">withdrawn by the De Vos administration<\/a>, which is currently crafting new guidelines.<\/li>\n<\/ul>\n<\/li>\n<li>Significant activism from organizations like <a href=\"https:\/\/www.knowyourix.org\/\">Know Your IX<\/a>, <a href=\"http:\/\/endrapeoncampus.org\/\">EROC<\/a>, and <a href=\"http:\/\/www.survjustice.org\/\">Survjustice<\/a>, which led to the 2013 <a href=\"http:\/\/edactnow.tumblr.com\/\">ED ACT NOW<\/a> campaign, demanding that OCR enforce its own policies. One of the results of this campaign was the Obama administration\u2019s creation of T<a href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2017\/01\/05\/fact-sheet-final-its-us-summit-and-report-white-house-task-force-protect\">he White House Task Force to Protect Students from Sexual Assault<\/a>.\n<ul>\n<li>As of 12\/15\/17, if you search for information about this task force on the current White House website, you\u2019ll see this:<\/li>\n<\/ul>\n<\/li>\n<li><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-671\" src=\"http:\/\/blogs.dickinson.edu\/landishouse\/files\/2017\/12\/Harding-blog-300x149.jpg\" alt=\"\" width=\"300\" height=\"149\" srcset=\"https:\/\/blogs.dickinson.edu\/officeofequityandinclusivity\/files\/2017\/12\/Harding-blog-300x149.jpg 300w, https:\/\/blogs.dickinson.edu\/officeofequityandinclusivity\/files\/2017\/12\/Harding-blog-768x382.jpg 768w, https:\/\/blogs.dickinson.edu\/officeofequityandinclusivity\/files\/2017\/12\/Harding-blog.jpg 974w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>The increasing adoption of <a href=\"http:\/\/endrapeoncampus.org\/yes-means-yes\/\">affirmative consent policies <\/a>by colleges and universities, and cities and states. Sometimes known as \u201cyes means yes,\u201d this approach to ending sexual assault recognizes the shortcomings of \u201cno means no\u201d policies.<\/li>\n<\/ul>\n<p>Dickinson\u2019s <a href=\"http:\/\/www.dickinson.edu\/info\/20226\/student_life\/1244\/sexual_harassment_and_misconduct\">sexual misconduct policy<\/a> relies on affirmative consent:<\/p>\n<p style=\"padding-left: 90px\">Consent to engage in sexual activity must be informed, knowing, and voluntary. Consent to engage in sexual activity must exist from the beginning to the end of each instance of sexual activity. Consent to one form of sexual contact does not constitute consent to all forms of sexual contact. Each participant in a sexual encounter must consent to each act of sexual activity.<\/p>\n<p style=\"padding-left: 90px\">Consent consists of an outward demonstration indicating that an individual has freely chosen to engage in sexual activity. Consent is demonstrated through mutually understandable words and\/or actions that clearly indicate a willingness to engage in sexual activity. Relying on non-verbal communication can lead to misunderstandings. Consent may not be inferred from silence, passivity, lack of resistance or lack of active response alone.
