    – شکایت کیفری را درهرکاغذی می توان نوشت و به مرجع قضایی برد ولی شکایت حقوقی حتماً باید درورقه مخصوصی بنام دادخواست نوشته شود حقوق دانان برتر والاً مورد پذیرش قرار نمی گیرد (ورقه دادخواست را در داخل دادگستری ها می فروشند)
    – شکایت کیفری را برای رسیدگی باید ابتداء به مرجعی بنام دادسرا برد و بعد از انجام تحقیقات در کلانتری و دادسرا , جهت رسیدگی به دادگاه فرستاده می شود. ولی دادخواست حقوقی باید مستقیماً به دادگاه برده شود.
    – شکایتهای کیفری را بدون استفاده از وکیل هم می توان در دادگستری مطرح کرد . ولی اکثر شکایت های حقوقی باید توسط وکیل دادگستری مطرح شود(مثلاً شکایتهایی که موضوع آن مالی و بیشتر از یک میلیون تومان است)
    – برای مطرح کردن شکایت کیفری (ازهرنوعی که باشد) فقط یک تمبر 2000 تومانی لازم است که در دادگستری برروی آن زده می شود . ولی برای طرح شکایت حقوقی , باید به تناسب ارزش مالی که راجع به آن دعوا مطرح شده یک ونیم درهزار تمبر باطل کرد (مثلاً برای گرفتن یک طلب 10 میلیون تومانی بالغ بر 150 هزارتومان تمبر لازم است.)
    – پرونده بسیاری از شکایت های کیفری حتی با پس گرفتن شکایت از طرف شاکی هم بسته نمی شوند(مثل شکایت راجع به رشوه, قتل, زنا و.. ) اما شکایت های حقوقی با پس گرفتن دعوا از طرف شکایت کننده , خاتمه می یابند.
